1. When does this Policy apply?
This Policy applies to the personal data we process as controller in connection with our website and our business relationships – that is, the personal data of website visitors, prospective and existing customers, and the contact persons of our partners and suppliers. “Personal data” is any information that can be traced back to you as an individual, such as your name, telephone number, email address, IP address or browsing behaviour.
This Policy does NOT cover the personal data processed within the talentguide SaaS-platform (for example, employee, candidate or evaluation data uploaded by our clients). For that processing, Talentguide acts as a processor on behalf of the client organisation (the controller); it is governed by the Data Processing Agreement (https://www.talentguide.com/data_processing). If you are an employee or user of a client organisation, please contact that organisation to exercise your rights in respect of platform data.

3. Whose data do we use?
We process the personal data of everyone who has had contact with us or visited our website, including visitors, private and business customers, and the contact persons of our partners and suppliers.
4. How do we obtain your data?
We receive data directly from you when you visit our website, create an account, submit information through our website, or contact us by email, telephone or other means. We also collect certain technical data automatically through cookies and similar technologies when you use our website (see section 13).

Depending on how you interact with us, we may process:
name and, where relevant, job title;
business or postal address;
email address and telephone number;
the content of your communications with us;
technical and usage data collected via cookies, such as IP address, device and browser information, and browsing behaviour on our website.
6. What do we use your data for, and on what legal basis?
We use your personal data only for specified purposes, each supported by a legal basis under the GDPR:
Providing our services and responding to enquiries: to answer your questions and manage our relationship with you – performance of a contract or steps taken at your request prior to a contract.
Administration, security, fraud prevention and risk management: to run and secure our business and website – our legitimate interests.
Marketing communications: to send you information about our products and services – your consent, or our legitimate interest in marketing to existing customers, in each case with the right to object or unsubscribe at any time.
Legal and tax compliance: to meet our legal obligations, including statutory retention requirements – compliance with a legal obligation.
7. How long do we keep your data?
We keep your personal data only for as long as necessary for the purpose for which we use it, and for as long as required by law. For customer data, we apply the statutory retention period of seven (7) years. After that period we retain only anonymised or aggregated data for statistical purposes, or the limited data necessary to handle complaints or legal matters. 8. Who do we share your data with?
We do not sell your personal data. We share it only with trusted service providers (processors) who act on our instructions and under appropriate data-protection obligations, and where required by law or competent authorities. Our providers include:

CRM platform: HubSpot
Website analytics and tag management: Google (e.g. Google Tag Manager / Analytics), subject to your cookie preferences
9. Where do we store your data?
We aim to process and store your data within the European Economic Area (EEA). Where a service provider processes personal data outside the EEA, we ensure the transfer is protected by an appropriate safeguard under Chapter V of the GDPR, such as an adequacy decision or the EU Standard Contractual Clauses. 10. How do we protect your data?
We have implemented appropriate organisational and technical measures to protect your data against loss and unauthorised access, and we ensure it is accessed only by authorised personnel. 11. What are your rights?
Because we process your personal data, you have the following rights:
Information and access: to be told, in clear terms, what we do with your data, and to obtain a copy of the data we hold about you.
Rectification: to have inaccurate or incomplete data corrected.
Objection: to object to processing, including processing for direct marketing and personalised recommendations.
Data portability: to receive the data you provided in a digital format and have it transferred to another organisation, where applicable.
Restriction: to ask us to limit our use of your data in certain circumstances.
Erasure: to ask us to delete your data, subject to legal retention obligations (for example, tax data kept for seven years).
Complaint: to lodge a complaint with us, with the Belgian Data Protection Authority, or before the courts of Talentguide’s place of business.
To make a request, email privacy@talentguide.com. We respond within 30 days; for complex or multiple requests this may extend to 60 days, and we may ask you to verify your identity.
12. Which rules apply to this Policy?
This Policy is governed by the General Data Protection Regulation (Regulation (EU) 2016/679) and Belgian data-protection legislation, together with the general rules of Belgian law.

14. Personal data of minors
We do not direct our website or organisation at minors. If you are under 18, you need the permission of a parent or guardian to use our website. If you are a minor visiting our website, we assume you have obtained that permission beforehand.
